The following are updates on State of California laws & regulations:

As of October 2013

AB 1252 Establishes changes to the California Retail Food Code.  The attached document is a summary of the Bill.  The highlighted sections are changes that impact the OAA nutrition programs, be sure to read the entire summary there is interesting information on service animals and other issues that may impact your food service systems. 

The Bill was further amended after the attached analysis to include a definition of “highly susceptible population.” 

 

“Highly susceptible population” means a group of persons who are more likely than other people in the general population to experience foodborne disease because both of the following conditions exist:

(a) The group is comprised of immunocompromised persons, preschool age children, or older adults.

(b) The group obtains food at a facility, including, but not limited to, a kidney dialysis center, hospital, nursing home, or senior center, that provides services, such as custodial care, health care, assisted living, or socialization services.

Residential Care Homes (AKA Board and Care Homes)

In California, there are today over 8100 licensed residential care facilities for the elderly. The term residential care refers to a system of non medical custodial care which can be provided in a single family residence, a retirement residence or in any appropriate care facility including a nursing home. More than 90% of the residential care homes are licensed for six or fewer residents housed in a private residential home setting. There are facilities licensed to care for more than six residents but they are usually retirement complexes or specialty facilities built to care for elderly people In this setting the facility is often called an Assisted Living Facility.

RCF Regulations

This law generally requires food facilities, except temporary food facilities, to have an owner or employee who has successfully passed an approved and accredited food safety certification examination from an accredited food protection manager certification organization, except as specified.

CALIFORNIA TRANS FAT BAN REQUIREMENTS

Beginning Jan. 1, 2011, no food containing 0.5 grams or more of artificial trans fat per serving may be stored, distributed, served by or used in the preparation of any food within a food facility.

Title 22 Regulations

Title 22 Regulations apply to all community care facilities regulated by the Community Care Licensing Division except where specifically exempted and are available at the California Department of Social Services website at:
